Terms & Conditions

Your participation in our program signifies that you have read, understand and agree to the Terms of Participation as stated in this document. If you do not choose to agree to any of these terms, you must discontinue the use of this website immediately.

The terms and conditions in this document constitute the entire agreement between the parties and shall supersede any prior oral, written or electronic agreement between the parties.

If any provision of this Agreement is prohibited by law or held to be unenforceable, the remaining provisions hereof shall not be affected, and the remaining terms and conditions shall continue in full force.

This document contains references to parties which are defined here:

  • The terms "you", "your", "yourself" and "customer" refer to the customer (a person using this website and/or participating in our program)
  • The terms "we", "us", "our" and "company" refers to FreeHeadset.org

We offer these headsets at greatly reduced prices (often free) because we feel that they can help make driving safer in situations where you must use your cell phone while driving.

Obviously we can not guarantee that using a headset will make you a better driver or aid in preventing any sort of accident, discomfort , injury or other ailment.

By participating in our program, you agree that the use of a cell phone headset and any information provided by our organization will be used entirely at your own risk.

Since we can not resell headsets that have been returned (even if the the prior owner did not use the headset); all sales are considered final.

Shipping and handling fees are non-refundable. Your MUST allow proper time for delivery; the delivery timeframe is one to six weeks, depending on order volume, delivery location and payment method.

Mail order payments will require and additional processing time of 3 to 21 business days depending on the date we receive the payment and order volume in our system at that time.

If you choose to send payment by check or money order and your payment is refused (NSF return, account closure, etc), a processing fee of $75 will assessed in addition to the full payment amount. If your returned check (plus all applicable fees) is not fully paid with-in 30 days of the date the check was returned, you will be assessed an additional processing fee (up to five hundred dollars) and your case will be forwarded to an attorney and/or collection agency for processing. In addition to these fees you will be required to pay all attorney and/or collection agency fees billed during the process of recovering the full payment amount plus all applicable fees.

If you choose to send payment using your credit card and you issue a chargeback, you will be assessed an processing fee of $75 in addition to the payment amount. If your returned payment (plus all applicable fees) is not fully paid with-in 30 days of the date the check was returned, you will be assessed an additional processing fee (up to five hundred dollars) and your case will be forwarded to an attorney and/or collection agency for processing. In addition to these fees you will be required to pay all attorney and/or collection agency fees billed during the process of recovering the full payment amount plus all applicable fees.

All credit card chargebacks will be considered fraudulent and will be reported to your local law enforcement for prosecution to the fullest extent of the law. Fraud will not be tolerated.

All legal matters are to be settled by arbitration in San Diego, CA USA. You agree to pay all costs involved with the arbitration process.

All sales are final. We do not offer refunds, credits or exchanges. However, if your headset is damaged during delivery, and you notify us with-in 2 days (form the date of delivery), we will be happy to exchange the damaged unit at no additional cost.

The maximum liability that the company shall have to the customer, at anytime, shall be less than or equal to the sum of all monies paid by the customer to the company.
